Terms of Service

Effective April 20, 2026. Please read these terms carefully. By creating an account or using HeyStack you agree to be bound by them.

1. Acceptance of terms

HeyStack (“HeyStack,” “we,” “us”) provides a music discovery and fan engagement service for emerging artists and listeners. By accessing the service you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 13 years old (or the minimum digital-consent age in your jurisdiction, whichever is higher) to create a HeyStack account. You must provide accurate registration information and keep it current. You are responsible for all activity on your account.

3. Your content and the license you grant us

You retain ownership of the audio recordings, artwork, metadata, and other content you upload (“Your Content”). By uploading Your Content you grant HeyStack a non-exclusive, worldwide, royalty-free license to host, reproduce, stream, transcode, cache, and display Your Content for the purpose of operating and improving the service. This license ends when you remove Your Content, except for copies retained in backups, analytics aggregates, or for legal compliance.

You represent and warrant that you own or have secured all rights necessary to grant this license, including rights from co-writers, performers, sample sources, and labels. HeyStack may remove content that appears to violate these representations.

4. Prohibited use

You agree not to use the service to:

  • upload content you do not have rights to distribute;
  • harass, threaten, dox, or impersonate other users or real people;
  • upload sexually explicit content involving minors, incitement to violence, or content that violates applicable law;
  • scrape, crawl, or extract bulk data from the service without prior written consent;
  • attempt to probe, attack, or interfere with the service's authentication, rate limits, or storage layer;
  • manipulate metrics (plays, likes, follows) using automation, bot accounts, or coordinated inauthentic behavior;
  • resell, sublicense, or commercialize the service's outputs except as expressly permitted here.

5. Moderation

HeyStack may review, restrict, hide, or remove content, and may suspend or terminate accounts, at its discretion when a plausible violation of these terms, our community guidelines, or applicable law is identified. We will typically notify you of significant actions against your account, but may act without notice in cases of imminent harm, legal requirement, or clear abuse.

6. Copyright and the DMCA

HeyStack respects copyright and responds to notices of infringement under the U.S. Digital Millennium Copyright Act (DMCA) and equivalent laws in other jurisdictions. To report infringement, submit the required information through our DMCA takedown form (identification of the work, the allegedly infringing URL, your contact information, a statement of good-faith belief, a statement made under penalty of perjury, and your physical or electronic signature). You may also email the same information to dmca@heystack.app. Repeat infringers will have their accounts terminated.

7. Paid features

Any paid features offered will be described on their respective pages with pricing, billing interval, and cancellation terms. Taxes may apply. Unless stated otherwise, fees are non-refundable once a billing period has started. We may change prices with at least thirty (30) days' notice to affected users.

8. Termination

You may delete your account at any time from settings. We may suspend or terminate your access for material or repeated violations of these terms. On termination, your license to use the service ends immediately; the content-license you granted us in section 3 survives only to the extent described there.

9. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, HeyStack disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee any specific result from use of the service, including discovery or revenue outcomes.

10. Limitation of liability

To the fullest extent permitted by law, HeyStack will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, revenues, data, or goodwill, arising from or related to your use of the service. Our aggregate liability for any claim will not exceed the amount you paid HeyStack in the twelve (12) months before the event giving rise to the claim, or USD $100, whichever is greater.

11. Indemnity

You agree to indemnify and hold HeyStack, its officers, employees, and affiliates harmless from any claim or demand, including reasonable attorneys' fees, arising out of Your Content, your use of the service, or your breach of these terms.

12. Governing law and dispute resolution

These terms are governed by the laws of the State of California, United States, excluding its conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts in San Francisco County for disputes not subject to binding arbitration. Where your local consumer-protection law provides stronger rights, those rights apply.

13. Changes to these terms

We may update these terms as the product evolves. Material changes will be announced in-product or by email at least fourteen (14) days before taking effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
